The perfect income for happiness? It's $161,000

By Robert Frank, CNBC

More than one study has tried to determine the financial price of happiness. Some look at wealth. Others look at income.

One well-publicized study last year put the optimal income for happiness at around $75,000. Rising income, it turns out, produces greater happiness until you get to around $75,000. After that, there are diminishing returns, with more income leading to little or no gain in real happiness.?

This is a fraught question, of course. ?Happiness? itself is not easily defined, and money?doesn't always guarantee it. And the financial requirements for happiness usually depend on geography, peer groups and other external factors.?

The latest to weigh in on the issue is Skandia International?s Wealth Sentiment Monitor. It found that the global average ?happiness income? is around $161,000 for 13 countries surveyed. The United States wasn?t specifically measured. (Read more: Why Millionaires Prefer Dogs)?

But there was a wide range of answers depending on the country. Dubai residents need the most to feel wealthy. They said the needed $276,150 to be happy. Singapore came in second place, with $227,553, followed by Hong Kong, with $197,702.?

The region with the most modest needs for happiness is Europe. Germans only need $85,781 to be happy, placing them lowest on the list. The French need $114,000, while the British need $133,000.?

The survey doesn?t ask about total wealth needed to feel happy. But it does ask about the amount of wealth needed to feel ?wealthy.? Globally, the average amount needed to feel wealthy was $1.8 million.?

Singaporeans took the lead on the ?wealth? needs, with $2.91 million needed to feel wealthy. Dubai ranked second with $2.5 million, followed by Hong Kong with $2.46 million. (Read more: Where to Live If You Want to Be a Millionaire)?

Surveys show that among Americans, most say they need $1 million or more to feel wealthy.

?All of this shows that wealth and financial happiness is not an absolute number, but is relative to your peers and surroundings. Living in Dubai, with all those oil barons and oligarchs, the needs are higher. In Germany, where wealth is more evenly distributed, the needs are not as high.

?How much wealth or income would you need to feel happy?

(AP) ? President Barack Obama is taking his case for avoiding a potentially unsettling "fiscal cliff" to the Philadelphia suburbs, employing campaign-style tactics in hopes of mobilizing public support. The trip comes amid signs of impatience in the negotiations between Republican leaders and the White House.

Obama was scheduled to go to Hatfield, Pa., to pressure Republicans to allow tax increases on the wealthy while extending current Bush-era tax rates for households earning $250,000 or less.

White House officials believe Friday's trip will build momentum for the president's case, even as Republicans describe it as an irritant and an obstacle to fruitful talks.

Obama was to tour and speak at the Rodon Group manufacturing facility, showcasing the company as an example of a business that depends on middle-class consumers during the holiday season. The company manufactures parts for K'NEX Brands, a construction toy company whose products include Tinkertoy, K'NEX Building Sets and Angry Birds Building Sets.

His trip comes a day after Treasury Secretary Timothy Geithner met privately with congressional leaders and presented a proposal calling for $1.6 trillion in higher taxes over 10 years and immediate spending to help the unemployed and struggling homeowners. The proposal, which Democratic officials described as a negotiation's opening bid, includes plans for legislation in 2013 aimed at saving $400 billion over 10 years from Medicare and other benefit programs.

Administration officials said the offer constituted much of what Obama has suggested in budget proposals.

One new feature in the Geithner plan is a call for increasing the nation's debt limit without the need for congressional approval. Under last year's debt ceiling deal, Obama simply had to notify Congress that he was raising the debt ceiling, a move that could be blocked only if both houses of Congress approved resolutions of disapproval that Obama could veto. The administration is seeking a similar arrangement going forward.

Following a closed-door meeting with Geithner, House Speaker John Boehner, R-Ohio, declared "no substantive progress has been made between the White House and the House" in the two weeks since congressional leaders met with Obama at the White House.

"Unfortunately, many Democrats continue to rule out sensible spending cuts that must be part of any significant agreement that will reduce our deficit," Boehner said.

At the White House, presidential press secretary Jay Carney took on a confrontational tone, saying: "There can be no deal without rates on top earners going up."

"This should not be news to anyone on Capitol Hill. It is certainly not news to anyone in America who was not in a coma during the campaign season," he said.

The tenor of the public remarks, however, suggested the hard bargaining was about to begin. Four weeks remain before the year-end deadline and negotiations such as these often don't gel until time is running out.

For Obama, the trip to Pennsylvania is part of a strategy to press his case publicly even while negotiating privately. He has already met with small business owners and with middle-class families in separate White House events. He has also invited business and labor leaders to the White House as well as Democratic operatives who can echo his plans on the airwaves.

Money mattered to David Wright

One idea that was frequently mentioned during the David Wright negotiations, and which has been confirmed by some post-signing reports, is that it was very important for David Wright to make more money than Johan Santana?s $137.5 million deal and thus become the highest-paid player in New York Mets history ?out of pride.?

Which I suppose I understand on some level. What I don?t understand is why anyone would say such a thing to a reporter. ?If you?re Wrights? agents, don?t you worry about that making your guy look kind of petty and/or ego-driven? If you?re the Mets leaking that, aren?t you risking some amount of clubhouse harumphing by essentially telling one player that the other wanted to top him?

Probably not the biggest deal in the world. After I tweeted about all of this, wondering if it would be awkward, one of my tweeps made a very logical point:

George Zimmerman offers signatures to legal fund donors | The Raw ...

By Eric W. Dolan

?

George Zimmerman is now offering those who donate to his legal defense fund a thank you card complete with his personal signature.

?We are, of course, maintaining the confidentiality of donors,? the website for his new legal fund states.

The managers of Zimmerman?s legal fund said Wednesday that his money had nearly run out. Countering rumors that the donations were being used to pay attorney fees, the fund managers insisted the money was first being used to pay Zimmerman?s living expenses and ?pay for costs associated with the defense.?

Zimmerman is currently unemployed and free on bond awaiting trial for second-degree murder.

He shot and killed unarmed black teenager Trayvon Martin in Sanford, Florida earlier this year. Zimmerman claims the shooting was in self-defense and cited Florida?s controversial ?Stand your ground? law.

Police initially failed to press charges against Zimmerman and the incident gained national attention as it was questioned whether the shooting was racially motivated.

?The New George Zimmerman Defense Fund will also be operated with the well-documented assertion that George Zimmerman was the victim of a coordinated public relations attack designed to assert that George acted with racial bias, a public relations attack that was perpetrated with the intent to prejudice the media and the citizens of this country with unfounded misinformation about George, and with the purpose of profiting from a tragedy,? the managers of his legal fund said.

New mechanism for cancer progression discovered

ScienceDaily (Nov. 27, 2012) ? The protein Ras plays an important role in cellular growth control. Researchers have focused on the protein because mutations in its gene are found in more than 30 percent of all cancers, making it the most prevalent human oncogene.

University of North Carolina Lineberger Comprehensive Cancer Center and Harvard researchers have discovered an alternative mechanism for activating Ras that does not require mutation or hormonal stimulus. In healthy cells, Ras transmits hormone signals into the cell that prompt responses such as cell growth and the development of organs and tissues. A mutation on the RAS gene can chronically activate those signals, leading to tumor initiation and progression.

In an article published on-line in a November issue of Nature Structural and Molecular Biology, the UNC and Harvard teams discovered that modification of Ras at a specific site with a small protein known as ubiquitin can also lock Ras into an active signaling state. Thus, modification of Ras with a single ubiquitin -- a process known as monoubiquitination -- switches Ras to an active signaling state by disrupting the action of another protein known as the GTPase activating protein, or GAP. Work by two of the papers co-authors, Atsuo Sasaki and Lewis Cantley of Harvard, had previously found evidence for Ras's potential to become activated and promote Ras-mediated tumorigenesis by monoubiquitination.

Because of the strong link between Ras and cancer, Ras should be an attractive target for drug discovery efforts. Despite considerable efforts at developing treatments targeting the protein, Ras itself is now considered to be 'undruggable', leading researchers to try new approaches to developing drugs that target activated Ras. This could lead to benefits beyond cancer therapies, as the RAS gene has also been linked to developmental disorders such as Noonan syndrome, Costello syndrome and autoimmune lymphoproliferative syndrome.

Lead researcher Rachael Baker, a PhD candidate doing joint work in the labs of Henrik Dohlman, PhD, professor of pharmacology and vice chair of biochemistry and biophysics and Sharon Campbell, PhD, professor of biochemistry and biophysics at UNC, developed a novel method to modify Ras with ubiquitin and then subsequently characterized how ubiquitin modification can lead to Ras activation.

The attachment of ubiquitin to Ras at a specific site leads to Ras activation, much like with an oncogenic mutation, leading to an increased potential for cancer formation. Baker notes that the reaction can be reversed by enzymes in the cell that remove ubiquitin, making these enzymes possible targets for future pharmaceutical research.

"Establishing how Ras is activated by ubiquitin is just the first step in understanding this novel mechanism of cellular regulation." said Campbell.

The researchers next step will be to obtain a more detailed understanding of its role in cancer progression, first in cells and in animals and eventually in cancer patients.

Most Affordable Car Insurance: And the Winner Is

Despite losing the presidential election, Mitt Romney can still be proud of the affordable car insurance rates in his home state of of Massachusetts. As of 2011, Massachusetts held first place for the most affordable state when it comes to auto insurance.

States With Cheapest Car InsuranceInsWeb ranked all fifty states and Washington D.C. according to an affordability factor. The formula used was very simple, but fairly accurate in terms of determining how affordable local auto insurance is in the area. A state?s affordability factor is determined by dividing its median household car insurance rate by its median household income.

The median car insurance rate is determined by actual customer profiles that can include multiple drivers, multiple vehicles and other variables. The lower the factor, the less a typical family in that state tends to spend on car insurance relative to its budget. Therefore a family who makes $40,000 per year and spends $400 per year is ranked similarly to a family who makes $200,000 per year and spends $2000 per year. This method of ranking is the best determination of affordability in any given area.

Following Massachusetts is Hawaii, which earned the number 2 spot, moving up from number 7 in previous affordability rankings. Other states which earned spots in the top ten include Minnesota, North Carolina, Utah, Wisconsin, Iowa, Idaho, Ohio and Vermont.

While many consumers don?t have the option to move out of state simply to save on insurance, there are a number of things you can do to save money on car insurance, regardless of where you live.

1. If you have young drivers in your family, your bill will inevitably be higher, but those young drivers with good grades may qualify for a Good Student discount for maintaining a 3.0, or being on the honor roll or dean?s list.

2. Another discount offered for high-risk drivers is Driver?s Defensive/Safety Course discount. Typically, students and senior citizens can take a safety driving course which is available at many local government offices.

3. Take measures to keep your car safe which will reduce the chance of theft and vandalism while earning you a 20 to 25% discount off your insurance premiums.

4. Check for Affiliate Membership discount. Members of large groups such as Costco, AARP or AAA may qualify for this discount.
?
5. If you have been with your insurance company for many years, ask about any available valued customer discount which recognizes your long-term relationship with the company in the form of a lower rate.

Regardless of where you live, safe driving is important for much more than your insurance premiums. Staying accident free and ticket free is the best way to keep insurance rates low and keep your family safe. Bigger cities often carry higher insurance rates because there is more traffic on the roads which increases the likelihood of an accident. Use caution and defensive driving techniques when driving in cities, and stay alert and awake on highways to keep you and those around you safe on the roads. Never drink and drive and always keep cell phones out of reach whenever you?re in the driver?s seat.

Obama signs bill shielding U.S. airlines from EU carbon fees

WASHINGTON (Reuters) - President Barack Obama signed a bill on Tuesday shielding U.S. airlines from paying for each ton of carbon their planes flying into and out of Europe emit, despite a recent move by Europe to suspend its proposed measure for one year.

The carbon fee bill was the first piece of legislation debated on the House floor after Congress returned from recess on November 13, and had been cleared by the Senate in September in a rare unanimous vote.

It directs the U.S. transportation secretary to shield U.S. airlines from Europe's carbon emissions trading scheme (ETS) if he or she deems it necessary.

Lawyers have said the bill is an unusual piece legislation because it would prevent U.S. companies from complying with the laws of another country.

"It never made a bit of sense for European governments to tax our citizens for flying over our own airspace ? and with the passage of this law we've got the tools we need to prevent it from happening and protect American jobs," said Democratic Senator Claire McCaskill, a co-author of the bill.

The House passed the bill despite the announcement on Monday that the European Union would "stop the clock" on enforcing its law for one year.

McCaskill and co-sponsor Republican Senator John Thune said in a statement that their bill had pressured the EU into delaying the enforcement of their cap-and-trade scheme for aviation.

The EU had also been under pressure from China, one of the world's fastest growing markets for aircraft, which had threatened to cancel orders of European Airbus aircraft if the EU did not back down from applying its ETS on all airlines.

One EU official took to the social networking site Twitter to suggest that United States was not making good on suggestions for "greener" policies.

Obama made reference to climate change as one of a trio of issues facing the country in his victory speech after being re-elected on November 6.

"So far the reelected President Obama climate policies look EXACTLY as in first term. Wonder when we'll see the announced change?" Connie Hedegaard, EU Climate Change Commissioner, said in a tweet.

(AP) ? Howard Kuljian and his family were out for a walk on a damp, overcast morning at Big Lagoon beach, playing fetch with their dog Fran as 10-foot surf churned the water just feet away like a washing machine.

Signs near the beach warned of "sneaker waves," the kind that suddenly roar ashore.

Kuljian tossed a stick that took the dog down to the water's edge, and in an instant, authorities said, a wave swallowed it, setting off a nightmarish scramble.

"Everything kind of snowballed from there," Coast Guard Lt. Bernie Garrigan said.

Kuljian's 16-year-old son, Gregory, ran to save the dog, only to be captured by the surging surf himself. Kuljian, 54, followed, and then his wife, Mary Scott, 57. On shore, their 18-year-old daughter, Olivia, and Gregory's girlfriend could only watch.

Both parents' bodies were later recovered, but the boy ? presumed dead ? is still missing.

The dog eventually made it back to shore.

News of Saturday's tragedy shocked many in the small college town of Arcata on the rough Northern California coastline about 280 miles north of San Francisco.

Students at Gregory's high school wore green in his memory Monday.

By late afternoon, more than 1,300 people "liked" a Facebook page set up by the teenager's friends called "Wear Green for Geddie" ? using his nickname. Dozens tweeted tributes with the hash-tag (hash)WearGreenForGeddie.

"I will always remember him no matter how long," wrote Emmalaya Owen on the Facebook page. "Especially how he was such an upbeat happy person or how he tried to put up 'Be Happy' propaganda posters he drew around school."

Others were trying to come to terms with the deaths. His sister graduated last year.

"He was just a friendly guy, and everyone who knew him liked him, and his family was very close," said Day Robins, a high school senior. She said Gregory and his family were active in school athletics and sailing.

At Big Lagoon beach, a short drive from Arcata, signs posted near the parking lot warned beachgoers not to turn their back to the surf and to pay special attention to sneaker waves.

"Because the beach is designed that way, when that 10-foot wall breaks, it surges up on the beach and surges back really fast," said Garrigan, the Coast Guard officer. "It's like a cyclical washing machine."

As the family walked along the beach, Howard Kuljian threw the stick and the dog gave chase, said Dana Jones, a state parks district superintendent.

Seeing his son in the water, Kuljian leapt to action, and disappeared into the frigid water.

Gregory managed to pull himself back onto the sand, but after realizing his father was drowning, both he and his mother went in to save him.

As Olivia and the girlfriend watched in horror, a nearby bystander called police. By the time help arrived, it was too late. Jones said the officer wasn't able to get to the family members because of the high surf.

Garrigan said the search for the teenager was stopped because a person without a wetsuit could not survive for long in the cold surf.

The Coast Guard deployed a helicopter and two motorized life boats to find the teenager, but thick coastal fog made the search difficult. The parks department also called off its search.

"When there is shorebreak like that, you don't even have to go into the water to be pulled into the sea," Jones said. "It's a reminder to be real careful around the ocean."

'Revenge' Scoop: Madeline Stowe Talks Jack And Amanda's Wedding And Hints 'A Couple' Will Die

Get ready for a lot of drama on "Revenge."

As Nick Wechsler, aka Jack Porter, told HuffPost TV last week, the Amanda does get shipwrecked, as the season 2 premiere revealed -- and someone goes down with the beloved boat. But, much like the first season with Daniel's (Josh Bowman) beach shooting, creator Mike Kelley likes to keep the fans and cast guessing.

"That's the thing: We don't know who this is on the boat," Wechsler told us.

But now Madeleine Stowe, who plays Victoria Grayson on the hit ABC show, is spilling some more secrets.

The actress tells TVLine.com, ?I sort of know who?s on it -- but there might be more than one person. I think Mike is actually still deciding.?

It's being assumed the boat will sink sometime before/during/after Jack and Amanda's impending nuptials, which could bring out numerous Hamptonites. So, could Victoria Grayson be a victim? Stowe isn't counting her character out.

As for the awaited Porter wedding, Stowe says it's definitely going to happen and that there will "at least be one death. Although she adds "a couple" might be a better assumption.

?We?ll see who gets blamed for it," she teases.

"Revenge" airs Sundays at 9 p.m. ET on ABC.

House to consider limited GOP immigration bill

WASHINGTON (AP) ? House Republicans still smarting from their poor showing among Hispanics in the presidential election are planning a vote next week on immigration legislation that would both expand visas for foreign science and technology students and make it easier for those with green cards to bring their immediate families to the U.S.

Republican leaders made it clear after the election that the party was ready to get serious about overhauling the nation's dysfunctional immigration system, a top priority for Hispanic communities. Taking up what is called the STEM Jobs Act during the lame-duck session could be seen as a first step in that direction.

The House voted on a STEM bill ? standing for science, technology, engineering and mathematics ? in September, but under a procedure requiring a two-thirds majority. It was defeated, with more than 80 percent of Democrats voting against it, because it offset the increase in visas for high-tech graduates by eliminating another visa program that is available for less-educated foreigners, many from Africa.

Republicans are changing the formula this time by adding a provision long sought by some immigration advocates ? expanding a program that allows the spouses and minor children of people with permanent residence, or green card, to wait in the United States for their own green cards to be granted.

There are some 80,000 of these family-based green cards allocated every year, but there are currently about 322,000 husbands, wives and children waiting in this category and on average people must wait more than two years to be reunited with their families. In that past that wait could be as long as six years.

The House proposal would allow family members to come to the U.S. one year after they apply for their green cards, but they wouldn't be able to work until they actually got the card. It applies to the families of green card holders who marry after getting their residency permits.

Bruce Morrison, a former Democratic congressman from Connecticut who chaired the House immigration subcommittee and authored a 1990 immigration law, said the bill neither increases the number of green cards nor gives people green cards early. But people "get the most important benefit of being able to live legally in the United States with their spouses."

Morrison, an immigration policy lobbyist who advocates for groups such as American Families United, called the bill a stepping-stone to more comprehensive immigration reform, That Republicans initiated it "to me is a positive gesture that they want to do business on this subject," he said

Megan Whittemore, spokeswoman for House Majority Leader Eric Cantor, R-Va., a key proponent of the STEM Act, said the bill is "family friendly, helping spouses and minor children who would otherwise be separated from their families for extended periods of time."

The bill will be taken up this time under normal procedures requiring only a majority vote, and it is almost certain to pass the Republican-led House. It remains to be seen whether it will engender enough Democratic support to give it momentum as it heads to the Democratic-controlled Senate.

It would give 55,000 green cards a year to doctoral and masters graduates in the STEM fields. The measure, strongly backed by U.S. high-tech companies, would make it easier for people trained in the United States to put their skills to work for American companies rather than non-American competitors.

But the legislation would still eliminate the Diversity Visa Lottery Program which gives out a similar 55,000 green cards a year to those from countries, including many in Africa, with traditionally low rates of immigration to the U.S. That prompted the House's Hispanic Caucus, Congressional Black Caucus and Congressional Asian Pacific American Caucus to all come out against it in September.

The three caucuses said Republicans were trying to increase legal immigration for people they want by ending immigration for people they don't want.

Crystal Williams, executive director of the American Immigration Lawyers Association, said the bill is a message from Republicans that "we are here and we are ready to talk about immigration reform."

But she said she doubted it will make much progress in the Senate during the short lame-duck session. People "are now starting to think about broader reform," she said, adding that a limited bill that doesn't increase visas won't get a lot of support.

Opinion: Is Ad blocking the next legal battleground?

Legal position on browser ad-blocking in New Zealand is likely to be influenced by what happens in the US

BY GUY BURGESS | AUCKLAND | FRIDAY, 23 NOVEMBER, 2012

?

Consider these two facts: Fact 1: many of the world?s largest internet companies, including Google and Facebook, derive most of their revenue from serving up online advertisements.

Fact 2: one of the most popular browser add-ons is Adblock Plus, free software designed to eliminate online advertising from a user?s browser, with the Firefox version alone recording close to one million downloads per week.

You don?t need to be a financial guru to see the potential problem here. Could browser ad blocking one day become so prevalent that it jeopardises potentially billions of dollars of online ad revenue, and the primary business models of many online and new media businesses? If so, it will inevitably face legal attack.

The concept of browser ad blocking software is simple: when a user opens a web page, the software detects any advertisements included in the page and automatically removes them while leaving the rest of the page intact. The user gets to view just the content they wanted (for example, the article or page of search results) without being bothered by banner ads, sponsored links or other advertising. Other claimed benefits include faster loading pages, reduced bandwidth, and reduced tracking of surfing habits. There is little if any downside for the user, but a big potential downside for the website and its advertisers whose paid ads are silently zapped before being seen ? and perhaps clicked on ? by the user.

Currently, advertising-supported sites seem unperturbed. Google itself ? the world?s largest online advertising provider ? offers Chrome-versions of Adblock directly from its official Chrome Web Store (somewhat incongruously boasting that it can even block video ads from Google?s own YouTube site). And there seems little cause for concern at present: online advertising is thriving, which suggests that ad blocking is not, statistically, too widespread.

But what legal steps might be taken if browser ad blocking does reach a point where it is seen as a threat to bottom lines and business models?

The legal position
There does not appear to have been any court case to date involving browser ad blocking. This may be an indicator of the lack of concern or loss, or of the difficulty of such a legal challenge, however there have been some US legal battles involving other forms of ad blocking/skipping that help set the scene for future legal fights.

An early example arose in the famous US ?Betamax case? proceedings of the late 1970s and early 1980s in which studios challenged the legality (under copyright law) of home video recorders. The studios claimed, in part, that ?the commercial attractiveness of television broadcasts would be diminished because Betamax owners would use the pause button or fast-forward control to avoid viewing advertisements?.

The Court rejected that claim because, it said, the viewer must still receive and record the commercials and then ?must fast-forward and, for the most part, guess as to when the commercial has passed?, a process which the Court said ?may be too tedious?.

Fast-forward to 2002, when several US networks sued the maker of the ReplayTV DVR in part due to its commercial-skipping features, alleging that such technology ?attacks the fundamental economic underpinnings of free television?. The case effectively ended after ReplayTV went into bankruptcy a short while later, so no legal precedent was set.

In a 2003 case involving file-sharing service Aimster, judge Richard Posner wrote that, based on earlier cases, commercial-skipping ?amounted to creating an unauthorised derivative work ? namely a commercial-free copy that would reduce the copyright owner?s income from his original programme, since ?free? television programmes are financed by the purchase of commercials by advertising?. However, commercial-skipping was not the focus of that case.

The issue was revived earlier this year, with CBS, Fox and NBC suing Dish Network over its commercial-skipping technology, saying they were doing so ?in order to aggressively defend the future of free, over-the-air television?. The legal basis of (part of) the claim is, in essence, that commercial-skipping infringes copyright by modifying the broadcast stream presented to end users.

It is not a particularly big leap to apply those arguments to browser ad blocking.

Could a legal attack be launched on browser ad blocking?

Two areas of law that could potentially be used in efforts to attack the legality of browser ad-blocking are:

1. Copyright law: it could be claimed that ad blocking constitutes copyright infringement, by causing unauthorised modification to a web page (which in many cases will be protected by copyright) ? that is, it creates an unauthorised adaptation of the page. As mentioned above, this has been the basis of television commercial-skipping lawsuits, and has received supportive comment from US courts.

2. Trade practices / commercial laws: it could be claimed that the use of third party software to remove paid advertising constitutes interference with contractual relations, eg an advertiser and a website have entered into a contract whereby the site will display an advertisement in return for a fee or commission, but this arrangement is being intentionally stymied by ad blocking software. Alternatively, it could be claimed that ad blocking software induces the breach of website terms and conditions that prohibit ad-blocking (if such a term is present, which currently is relatively rare).

Both of these scenarios have significant legal and practical challenges in the context of browser ad blocking, but are not inconceivable if the targets are the identifiable distributors of the ad blocking software or the maintainers who update ?filter lists? that the blockers commonly rely on, as opposed to targeting end users. Likewise, if a browser distribution started to bundle and enable ad-blocking features by default, it could become a target for legal action.

Another possibility is specific regulation, where a law is passed that specifically bans the use or distribution of ad blocking software.

Similar precedent is found in laws banning the sale of digital rights management ?circumvention devices? (ie in New Zealand, s 226A of the Copyright Act 1994 bans the sale or distribution of such devices in certain circumstances).

Notably, New Zealand?s law does not ban the private use of DRM circumvention devices. This partly reflects policy decisions about intellectual property and user rights, but also acknowledges the practical difficulty of banning private use of such devices.

It would be draconian, as well as practically impossible, to attempt to prevent users from carrying out their own ad-blocking. Attempts to prevent the creation or distribution of ?filter lists? raises significant freedom of speech issues.

How to Get Your Business on Apple's Passbook

The long-term?overall impact of Apple?s Passbook has been a hot topic over the last two months since it was launched with iOS 6 on the iPhone and iPod Touch.

But one thing is for sure: if you?ve got a business ? small, medium or large ? where getting people in the door is important, and are looking to follow in the footsteps of the likes of?McDonalds,?United Airlines,?Eventbrite,?MLB,?Starbucks,?American Express?and others, you should at least be looking into Passbook.

We wanted to go over the basics of what constitutes a Passbook ?Pass?, and give you some insight into how to go about building your own Passes from scratch, because, unlike building a full-fledged iOS app (or even a mobile friendly version of your website), Passbook in most cases should require less development time to get your brand onto someone?s iPhone (although like anything, the more complicated the Pass the more work will be required).

Also, for businesses that don?t want to bother with development at all, even though Passbook functionality has just recently been introduced, there is already a healthy number of still-kinda-in-beta third-party services that promise to take most if not all of the technical aspects out of creating Passes, and we take a quick look at those as well.

DIY Passes

passbook overview Dont Pass this up: Getting your business on Apples Passbook, DIY style

First of all, it?s important to understand that Passes are not apps?? Passbook is an app (that is installed by default on iPhones with iOS 6 nd can?t be removed), but the actual Passes (coupons, whatever) are just a file type that only works on iOS 6 (iPhone, iPod Touch ? not iPad right now) and in?OS X 10.8.2.

When a user clicks on a Pass file (for example: example.pkpass) on any of those devices it will add it to Passbook, and, if the user has iCloud set up, it?will sync the Pass across all of the user?s devices. So a Pass can be completely independent of an iOS app ? or, if you do have or are planning to build an iOS app, Passbook can be integrated into your app as well.

There are currently five Pass types; Boarding Pass, Coupon, Event Ticket, Store Card, or ?Generic? (yes, that can cover a lot of things) and each of them has their own look and feel, although in all cases, the look is generally a solid color background with as little text as possible and a 2D barcode that can be read by laser and optical scanners. Apple ? a bit smugly ? suggests that you could use the camera of an iPhone/iPad as your in store scanner.

Unless you run an airline, train or bus company, we?re guessing the use of the Boarding Pass, um, Pass, isn?t on your radar.?The other four, however, are all Passes that many businesses that rely on getting people to walk in the door can use. For example, a fitness club could use the Coupon Pass to get new members, who then could get a Store Card they could use daily as a membership card, and if the club held a special event, the Event Ticket Pass could even be used as well (although most likely you?d just use the Store Card for entry, but we?re being hypothetical here).

For each of these Passes, you can also set date/time and location alerts that push to a user?s home/lock screen at the appropriate place and time. Beyond the simplified, digital wallet interface of the Passbook app, and of course the tremendous number of iPhones in use, these place/time push notifications should be very attractive to many businesses.

Even better, like the rest of a Pass, businesses have the ability to push changes to the Pass to alter these parameters (so if your event gets delayed, all you have to do is push out the time change and the Pass will show a notification at the new time).

passbook timelocation Dont Pass this up: Getting your business on Apples Passbook, DIY style

Passes are two-sided ? the front is your coupon/ticket/membership card/etc., and the back has your contact information, the option to delete the Pass from Passbook, and a link that opens up your iOS app if you a) have one, and b) the user has installed the app. While it?s obviously a bit obscured on the back of the card, if you do have an app and the user hasn?t downloaded it yet, this is a nice little bonus channel for app installs, although it will probably be a small one.

The .pkpass file is a compressed (zipped) file that contains the images, text, and server files that constitute the Pass. The server commands that you?ll need to code to run a basic Pass aren?t very complicated ? but of course, if you are building a very dynamic Pass that heavily integrates into your back-end systems, it will most likely get much more complicated. The good news is that Apple has some very clear documentation on developing for Passbook, and simple, non-dynamic passes are pretty straightforward.

The compressed Pass file must be signed using an Apple developer key, and this is an important point: according to Apple?s rules, all Passes must be signed by a unique developers key that is owned by the business that this producing the Pass. Apple says that if you use a ?contractor? they should be using your development key that is associated with your brand/identity/business etc. If you already have an iOS app, you should be able to associate that with your Passes using this signed key as well.

How this rule meshes with the third-party apps we?ll cover below seems to be a grey area at the moment ? if there are any lawyers reading this, we?d certainly be interested to hear your take. However, if you share your own key (yes, you?ll need to cough up the $99 a year Apple development fee) with a freelance developer, you?re certainly in the clear with Apple.

Once you have a Pass ready, getting the word out about the Pass is simple enough, especially after Apple recently introduced the ?Add to Passbook? button, which gives visitors to your website, or readers of your email newsletter, a?recognizable?(at least eventually) reminder to add a Pass. Passes can also be shared or installed by a link without the badge (as with the ?Add to Passbook? badge, the user just clicks on the link and the device automatically?recognizes and adds the Pass to the user?s Passbook) as well.

So, if you have access to a development team and a designer, in our estimation you shouldn?t be afraid of building your own Passes ? especially if you don?t plan to make them to dynamic (for instance, changing remaining balances on the card in near real-time would be trickier), they shouldn?t take take too much development effort to complete.

Another bonus is that if you are planning multiple Passes of the same type (for instance, a weekly Coupon) most likely after you built it once, updating for new Passes shouldn?t take much effort. At the very least, if you have a development team and/or work with an outside developer already and are interested in Passbook, have them take a look at Apple?s documentation to see what kind of investment it will take to get going.

However, if you don?t have access to development resources (or just want a solution that takes the tech out of it), as we said, a number of services have already popped up that offer Pass creation and management.

Pass creation services

Since the launch of iOS 6 in September, there has been a wave of services/startups that are focusing on tools for marketers to build, share and track Passes.

As Passbook becomes used more widely, marketers and business owners ? many of whom have no development resources or experience ? will want an easy to use but powerful service to build, distribute and track the success of Passes. A very similar ecosystem was created for Facebook Pages as well as of course for mobile apps themselves, but all things being equal, Passes are much closer to the development commitment needed for Facebook Pages than they are to mobile apps, so it?s not surprising these services were able to get up and running so quickly.

In a not-t0-distant-future article we?ll do a full-review of all of these and other similar services (many of which seem to be, quite frankly, in, or still hardly out of, beta), but if you are interested to try them out now (some have a trial period) before our review, here are some that we?ve hit upon so far in no particular order:

If you know of any other services like these, please just let us know in the comments and we?ll take a look for our review.

So, if you?re a business that is thinking of getting going with Passbook, hopefully this article has taken a little bit of the fear out of the way, and you can start thinking about what you?d like to start offering users and whether to do the development on your own, find a developer to work with or give a third-party service a shot.
