Can Marriage Be Divided into Secular and Religious Institutions?

Once again, I do not think that the state needs to give tax breaks, lowered tuition costs, and other benefits that are granted to heterosexual marriages because same sex relationships, in principle, need not be encouraged to have children.

However, I think that it is appropriate for there to be a legal category for those who have declared each other to be their new family which is separate from their biological family. Family plans with regards to insurance seems appropriate for these relationships.

If adoption agencies decide that the couple is financially stable and would provide an emotionally/physically/psychologically safe environment for the couple to raise a child, I think that the state ought to provide the same kind of tax breaks for the couple which is raising a child in the best way they can.

New robots crawl like sea turtles

Researchers have designed a new type of robot modeled on sea turtles known as FlipperBot. This is the first robot to use flippers against pliable surfaces and has moved the work toward amphibious robots forward.

Flippered robots inspired by sea-turtle hatchlings could shed light on how the ancestors of terrestrial animals first evolved to crawl on land, researchers say.

Such research could also lead to amphibious robots that can tackle both land and sea, investigators added.

Scientists are designing robots that can go where humans cannot or should not go, and often rely on inspiration from nature to do so. For instance,?snakelike robots?could, in principle, slither into crevices to help find disaster victims.

Challenging environments for robots to cross include?sand, gravel, soil, mud and other unstable granular surfaces?that can deform around legs in complex ways. To learn new ways to navigate such ground, Daniel Goldman, a physicist at the Georgia Institute of Technology in Atlanta, and his colleagues investigated sea-turtle hatchlings.

"These little turtles are remarkably effective at moving over solid ground, with limbs designed for moving in fluid," Goldman told TechNewsDaily.

The researchers analyzed 25 baby loggerhead sea turtles from nests on Jekyll Island, one of Georgia's coastal islands, at night. They investigated how the turtles crawled on tracks of beach sand housed in a truck parked near the beach, video-recording them as they moved in the darkness toward a light that simulated the moon. Goldman and his colleagues Nicole Mazouchova and Paul Umbanhowar were surprised to learn the hatchlings moved about as quickly on soft sand as they did on hard sand.

"The turtles insert their flippers just deep enough into soft sand so that the material does not yield behind the flipper as they move," Goldman said. "That means the sand doesn't flow around the flippers, and they don't slip ? so they can propel themselves."

The key to performing well, regardless of the conditions of the sand, seemed to lie in how the turtles controlled their wrists.

"On hard ground, their wrists locked in place, and they pivoted about a fixed arm," Goldman said. "On soft sand, they put their flippers into the sand, and the wrist would bend as they moved forward. We decided to investigate this using a robot model."

These findings led to the development of FlipperBot, the first robot to employ flippers against malleable surfaces. The small droid is about 7.5 inches (19 centimeters) long, weighs 2 lbs. (970 grams), and has two motor-driven flippers with flexible wrists similar to sea turtle wrists

Global stocks rise after surprise U.S. data, bonds fall

NEW YORK (Reuters) - World equity markets rose and bond prices fell on Thursday as data indicated the U.S. labor market remains resilient despite recent signs of slower growth, while earnings that are beating lowered expectations helped buoy investor sentiment.

Wall Street opened higher, following gains in Europe, where markets were lifted on growing expectations the European Central Bank will soon cut interest rates.

A report from the U.S. Labor Department said the number of Americans filing new claims for unemployment benefits fell last week by a surprisingly large 16,000.

The report appeared to counter several weeks of signs that U.S. economic activity softened in March and early April, a phenomenon that economists have dubbed the spring swoon because it has happened the past two years.

Benchmark 10-year U.S. Treasury notes fell as much as 7/32 in price in reaction to the jobless claims figures. They last traded 3/32 lower to yield 1.7114 percent.

Recent weak global economic data, including record-high jobless figures from Spain on Thursday, has sparked expectations of more stimulus from central banks.

"Overall, investors see the potential for new measures and the distortion of global valuations as a reason to hold dogmatically onto their equities," said Guy Foster, head of portfolio strategy at Brewin Dolphin in London.

"Shares are seen as a yield asset class with risks skewed to the upside. Bonds have lost their appeal for the opposite reason."

U.S. stocks rose, boosted by gains in shares of materials companies, including iron ore producer Cliffs Natural Resources Inc ,

Cliffs jumped 17.78 percent to $21.46 after it posted earnings late on Wednesday that were much better than analysts had estimated. [ID:nL2N0DB2FF] The S&P 500 materials index <.splrcma> rose 1.4 percent.

The blended per-share growth estimate for earnings is now 3.6 percent, according to Thomson Reuters, up from 1.5 percent on April 1. The estimate is about half of recent quarters.

The Dow Jones industrial average <.dji> was up 15.36 points, or 0.10 percent, at 14,691.66. The Standard & Poor's 500 Index <.spx> was up 5.39 points, or 0.34 percent, at 1,584.18. The Nasdaq Composite Index <.ixic> was up 19.42 points, or 0.59 percent, at 3,289.07.

"Investors coming into this earnings season were quite fearful, so even modestly positive news becomes great news and that is what we've experienced for the last several days," said Lawrence Creatura, an equity portfolio manager at Federated Investors in Rochester, New York.

"It's probably a little early in the earnings season to talk about aggregate results but it's important to recognize that earnings are growing and so higher prices are deserved," Creatura said.

Expectations of an ECB rate cut boosted shares and kept the euro near a three-week low to the dollar. Sources involved in the deliberations have told Reuters that momentum is building for monetary action to help the recession-hit euro zone.

The FTSE Eurofirst 300 index <.fteu3> index of top European shares rose 0.74 percent to close at a 1,200.64, near its peak of 1,209.05 it hit in mid-March.

MSCI's all-country world equity index <.miwd00000pus> gained 0.62 percent to a 365.19.

The dollar rose against the euro as the U.S. labor market report allayed concerns about the pace of the economic recovery, with many analysts expecting the greenback to continue to gain.

The euro last traded at $1.3005, down 0.08 percent.

Against the yen, the dollar last traded at 99.31 yen, down 0.16 percent on the day.

Sterling jumped to a two-month high against the dollar and a three-month peak against the euro after data showed the UK economy comfortably avoided slipping back into recession in the first quarter.

UK gross domestic product rose 0.3 percent in the three months to March, well above forecasts of a 0.1 percent rise, as the economy bounced back after shrinking 0.3 percent at the end of 2012.

Brent crude oil prices held above $102 a barrel, underpinned by a weaker dollar, while U.S. crude's discount to Brent fell below $10 for the first time since June 2012.

Brent crude rose $1.68 to settle at $103.41 a barrel.

U.S. crude settled $2.21 higher at $93.64 a barrel.

With so many customization option given by the game, creating your character is not going to be too hard. We have taken a good look at each of the races available and understood that each one of them comes with its own strengths and weaknesses: some are better suited at being warriors while others are better at magic or stealth.

In creating your character and getting him or her ready for battle and adventure you?ll probably need some good understanding on how skills work. Skills determine your proficiency at everything that can be done in the world of Skyrim. Unlike previous The Elder Scrolls game, skills aren?t determined by the character class: the specialization of skills comes with the Perks system.

All Skills improve depending on the action you do: improving some of them can be somewhat tedious. There are other ways to improve skills without having to repeat some actions over and over: you can improve them by getting your hand on a Skill Book or find some Trainers who will help you improve specific skills.

Trainers can only train you five times per level: to get them to train you again you will have to raise you level. This limit doesn?t apply to a single trainer but to all: if you have already trained three times with a single trainer, you can only train two more times with another trainer. To start training again you will have to level up.

Some followers will also be able to train you: this actually comes with an advantage since you can get your money back by going through their inventory.

There?s also another trick to earn some good XP if you have the horse Shadowmere: this horse cannot be damaged by magic, direct and ranged attacks. Keep attacking him to earn some easy XP.

Archery

Archery is, quite obviously, the skill and training needed to handle bows. Improving this skill tree will allow you to become better in ranged attacks with a bow. Gaining some good perks in this skill tree is actually essential if you?re looking to create a hybrid build or a character who?s able in giving both direct and indirect damage. Stealthy types of characters also benefit greatly from this skill tree.

Bangladesh factory building collapse kills over 70, injures hundreds

DHAKA (Reuters) - An eight-storey block housing factories and a shopping center collapsed on the outskirts of the Bangladeshi capital on Wednesday, killing more than 70 people and injuring hundreds, a government official said.

Fire fighters and army personnel worked frantically through the morning at the Rana Plaza building in Savar, 30 km (19 miles) outside Dhaka, to rescue people trapped inside.

One fireman told Reuters that about 2,000 people were in the building when the upper floors jolted down on top of each other.

Bangladesh's booming garment industry has been plagued by fires and other accidents for years, despite a drive to improve safety standards. In November last year, 112 workers were killed in a blaze at a factory in an industrial suburb of Dhaka.

"It looks like an earthquake has struck here," said one resident as he looked on at the chaotic scene of smashed concrete and ambulances making their way through the crowds of workers and wailing relatives of those still inside.

"I was at work on the third floor, and then suddenly I heard a deafening sound, but couldn't understand what was happening. I ran and was hit by something on my head," said Sohra Begum a worker at one of the garment factories.

M.M. Niazuddin, the government's health secretary, told Reuters that at least 76 people were confirmed dead. Another official said hundreds were being treated for injuries.

Mohammad Asaduzzaman, in charge of the area's police station, said factory owners appeared to have ignored a warning not to allow their workers into the building after a crack was detected in the block on Tuesday.

Buildings in the crowded city of Dhaka are sometimes erected without permission and many do not comply with construction regulations. Dozens died when a garment factory collapsed in the same area eight years ago.

Bomb suspect influenced by mysterious radical

WASHINGTON (AP) ? Family members of the suspect in the Boston Marathon bombings who died in a shootout with authorities say that the suspect, Tamerlan Tsarnaev (tsahr-NEYE'-ehv), had fallen under the influence of a Muslim convert who steered the religiously apathetic young man toward a strict strain of Islam.

His family says that, under the tutelage of a friend known to the Tsarnaev family only as Misha (MEE-sha), Tamerlan gave up boxing and stopped studying music. He began opposing the wars in Afghanistan and Iraq and turned to websites and literature claiming that the CIA was behind the terrorist attacks of Sept. 11, 2001, and that Jews controlled the world.

Tamerlan's uncle, Ruslan Tsarni, tells The Associated Press that the mysterious friend, quote, "just took his brain."

Stocks open little changed on mixed earnings news

NEW YORK (AP) ? Stock indexes are little changed in early trading on Wall Street following mixed earnings results from Apple, Ford, Boeing and other major U.S. companies.

The Dow Jones industrial average and the Standard & Poor's 500 index were moving between small gains and losses shortly after the opening bell Wednesday.

As of 9:45 a.m. Eastern the Dow was down seven points at 14,715 and the S&P 500 was up two points at 1,580.

The Nasdaq composite was up four points at 3,273.

Earnings will continue to roll out this week.

Online game maker Zynga reports after the closing bell. For the remainder of the week, earnings are expected from Dow Chemical, Southwest Airlines, UPS, Exxon Mobil and Burger King.

Game Show Warriors Combines Manga Comic And Casual Gaming ...

Inzen Studio, a small game startup in Singapore has just released an ambitious project called Game Show Warriors. The launch kicks off with the release of an iOS game called Amazing Studly Strikes, but the studio has quietly released the first two episodes of a Web comic, and episode three just dropped to accompany the release of the mobile game.

The game app will also include the Web comic, according to Inzen?s co-founder, Gerald Tock.

Inzen was started in October last year. Update: Its core team of six is spread out across Singapore, China and Uruguay. Four of them?game designer, technical lead, marketing and product strategist, and lead designer are based in Singapore. The lead artist is in Uruguay and Inzen?s producer is in China.

Inzen Studio, Game Show WarriorsThe comic and its first game center on a character they created, G-man Studly. The game appears to be a tapping frenzy, with waves of enemies attacking G-man Studly from different corners of the screen, requiring you to tap on them furiously as your character scales a skyscraper.

Tock said the team is hoping to make the rest of its project happen. It has enough material for another ?larger? game and four mini games to be produced under the Game Show Warriors banner. It plans to wait for the response to the first episode to decide whether to continue, however.

Besides having people download and play their games, Inzen is hoping that the investment into the online manga will get fans making derivative works such as fan fiction, videos or cosplaying as the characters.

The five founding developers in Singapore are graduates?ex-developers from the Singapore-MIT Gambit Game Lab. Prior to creating this project, some of them produced apps that enjoyed some success on the mobile scene. Dark Dot was a shooter they produced in 2011 that climbed to the top of the action charts in 48 countries including China, the US and Singapore, and was the top free iOS app in several Southeast Asian countries.

Eating Niagara: Cooking up collaboration between old and new ...

I love Food & Drink magazine. Every time I see an issue, I want to lick it's colourful, glossy pages. If it wasn't so gauche, I'm certain it would prove that you can actually taste whatever dish or drink is printed on them.

I don't often get a copy in my clutches because my fellow drinkers who frequent the same neighbourhood libation station known as the LCBO seem as ravenous as me when they see the magazine hot off the press and temptingly on display at the store's entrance.

The copies I do have, I squirrel away in a special place ? my cookbook cupboard. They are dog-eared, buckled and stained from ingredients I drop on them while concocting the recipes on their pages.

Given that history, I couldn't wait to sit in on Lucy Waverman's session at the recent Food Bloggers of Canada conference in Hockley Valley. Lucy is the magazine's food editor. She's also food writer royalty in my world, writing a regular column for the Globe and Mail. I unabashedly covet her job and I planned to hang on to her every word as she talked about the new face of food writing.

I gathered, though, from what she had to say, that it's a face she doesn't love.

Certain messages from her talk still echo more than a week later: food bloggers are said to have taken the joy out of cooking because we don't test our recipes; don't expect to make a mint from a cookbook or even think that publishing one will be easy; and the one that really haunts me ? most people in the industry feel that food bloggers are pushovers. We'll write about anything for a freebie.

I blog about food but I'm not a pushover. I will not shill for a free bag of pasta, nor have I despite the offers being plentiful.

It's obvious to me that in some cases I'm not being chosen to receive free product because a company loves my blog or my ability to craft a sentence. They love me because I'm good for their marketing bottom line (read: cheap labour).

Still, I wasn't angry at Lucy's bluntness. In fact, I appreciated when she asked if anyone in the room had worked with an editor or been through the rigorous fact-checking process. I was one of three people who raised my hand.

I liked how forthright she was when she told us to ask permission to use someone's recipes on our site and to test vigourously when creating our own.

When she reinforced the need for bloggers to be authentic and ethical, I cried out hallelujah in my head. I was unfazed by her honesty and her lack of warmth and fuzziness when doling out the truth. We've all read bad blogs, be it about food or anything else, and as someone who strives to bring the same values I learned as a journalist to my hobby, I was grateful for her candor.

Others weren't, however.

Maybe it's because I've spent a decade in newsrooms and know they are places where punches aren't pulled. Thick skins are required or grown in a hurry, and being mindful of the feelings of others isn't always top of mind when filling pages and meeting deadlines.

But many who joined me in the session were offended by Lucy's assessment of food blogging. They thought?she was a downright downer while the rest of the conference had such a positive tone.

It was obvious she was leery ? and weary ? of food bloggers, particularly after relaying a bad experience she had working with one on a story for Food & Drink.

How unfortunate, really. Those of us who were at the conference were there because we want to see food bloggers upholding the same standards Lucy uses in her own work.

We all know there are pushovers, those who will sellout for a jar of salsa or free tickets to the food event du jour, just like Lucy says.?But I'm confident that I wasn't sitting in a room of those people.

One conference goer even suggested traditional media and bloggers could work together. He has seen it happen in his hometown of Calgary. But Lucy made it seem as though it were impossible in Toronto. Too many pushovers and hacks, perhaps, using new media as their outlet, and people had caught on to the problems with food bloggers.

To that I say, Lucy, give us a chance. It's not you versus us. We can only be better if we collaborate, a message reinforced recently when I sat in on a talk by legendary television producer Ralph Mellanby, who spoke to a group of up-and-comers lusting after his job.

Mellanby, who won five Emmys for his television production of several Olympics, didn't tell his proteges he doubted they had what it takes to make it in the industry. He urged everyone to work together because the person they were sitting next to could one day be their boss or can teach us a thing or two.

?That person sitting next to you is as big as any producer walking in. You need to work together, not stab each other in the back," Mellanby said. "When you see great shows? that?s not a big producer. That?s the cameraman? the whole crew.?

To my fellow bloggers, I say find someone in the world of traditional media and reach out to them. Ask them for feedback about your work, interview them about how they do their job, deal with unexpected hurdles or come up with story ideas. Find a willing mentor because the Lucy Wavermans of the world have so much to offer us. And don't dismiss them because you don't like what they have to say.

We need to work together, We all have much to learn from each other. To do so will only make the industry of food writing better, more authentic and ethical, just like Lucy Waverman ? and us food bloggers ? want it.

Grill Both Sides of the Bread for the Perfect Grilled Cheese Sandwich

Making a grilled cheese sandwich isn't rocket science, but making a great grilled cheese sandwich is a bit of an art. Thankfully, J. Kenji L?pez-Alt over at Serious Eats shows us how to get the best grilled cheese every time. For starters: grill both sides of the bread, then add the cheese.

Kenji goes through all of the elements of making a great grilled cheese: using the right cheese and the best bread. You've probably heard the rules: pick a flavorful melting cheese, stick with slices over grated cheese, day old bread works well for grilled cheese, and don't use a bread with too many holes.

However, he also tackles the method of making that sandwich so you get the best possible results. Here's what he suggests:

The best method I've ever seen for making a perfect grilled cheese comes from Adam Kuban. His secret? Grill the bread on both sides. That's right. Grill two slices of bread in butter, flip'em over so that the browned sides are facing up, add your cheese, and close your sandwich so that the cheese is sandwiched between the browned surfaces. Not only will this get you better tasting bread infused with more butter, but it'll also give your cheese a head start on getting extra-melty.

He also suggests using salted butter instead of unsalted (or seasoning the sandwich with a pinch of kosher salt), and points out that low and slow is the best way to cook your grilled cheese: That the browning you get should be browning of the bread, not the milk solids in the butter (we have a tip to help make sure you don't over-brown, too). Pakistani judge orders Musharraf held for 14 days

ISLAMABAD (AP) ? A Pakistani judge on Saturday ordered former military ruler Pervez Musharraf be held in custody for two weeks until the next hearing in a case related to his 2007 decision to sack and detain several judges.

The police then declared Musharraf's lavish country residence a jail, paving way for him to be taken and held there under what is essentially house arrest.

The development is the latest act in the drama surrounding Musharraf that erupted earlier this week and climaxed with his arrest Friday after a speedy escape from another court hearing.

The former general, who seized power in a coup and ruled Pakistan for nearly a decade, has seen his fortunes plummet since he returned in March after four years in self-imposed exile.

The arrest of such a prominent military figure in a country that has experienced three coups has unsettled Pakistan at a time when it is preparing for historic elections on May 11.

Saturday's order came at a hearing in an Islamabad court, where Musharraf was brought under heavy security as supporters and opponents gathered outside the court.

The judge ruled that he would be given judicial remand, which means that he would be held in custody until the next hearing on May 4. Musharraf's legal team had been pushing to get his estate on the edge of Islamabad declared a sub-jail under Pakistani law.

The Islamabad chief commissioner later issued a notification declaring the residence a jail, said police official Mohammed Khalid. Musharraf, who was taken from the court back to the police guesthouse where he had spent the night, was to be transported later Saturday to his private house in the country to remain there under house arrest.

Musharraf was arrested in the case that stems from his decision, while in power, to sack and detain the judges, including the country's chief justice, after declaring a state of emergency and suspending the constitution.

At the time, Musharraf was apparently concerned the judges would push back against his re-election as president. As a justification for the state of emergency he also cited the growing Taliban insurgency in the country's northwest.

But the move backfired horribly. The country's lawyers took to the streets in widespread protests that eventually weakened Musharraf's government so much that he was forced to call new elections and step down.

A judge has said Musharaf's 2007 decision amounted to terrorism, which is why the case is now being heard before an anti-terrorism court. Such courts are closed to the media and the public.

Musharraf returned to Pakistan last month to make a political comeback and contest the May 11 election. But he was greeted with little popular support and was disqualified from running in the election. A judge on Thursday ordered his arrest.

That sparked a dramatic escape by Musharraf from court in a speeding vehicle after which he holed up in his heavily guarded house on the outskirts of Islamabad until he was taken into custody on Friday morning.

Musharraf seized control of Pakistan in a coup in 1999 when he was army chief and spent nearly a decade in power before being forced to step down in 2008. He returned despite Taliban death threats and a raft of legal challenges.

He also faces legal charges in connection with the 2007 assassination of the former prime minister Benazir Bhutto and the 2006 death of a Baluch nationalist leader.

But it has been the case of the judges that has sparked the most contention since Musharraf's return ? a reflection of the deep animosity many in the legal sphere still have for the former strongman.

His arrest is a significant act in a country where senior army officers have long seemed untouchable. The army is still considered the most powerful institution in Pakistan, but its aura of impunity has declined in recent years, especially in the face of an activist judiciary.

When Musharraf entered the court Saturday, he was surrounded by a phalanx of police and paramilitary Rangers. Pakistani lawyers chanted: "Whoever is a friend of Musharraf is a traitor," while supporters shouted: "Love live Musharraf!"

Musharraf has described the allegations as politically motivated.

"These allegations are politically motivated, and I will fight them in the trial court, where the truth will eventually prevail," Musharraf said in a message posted on his Facebook page after his arrest.

Musharraf had hoped to regain some of his power by winning seats in the May 11 election. That vote will mark a significant milestone for Pakistan which has seen its democratic evolution stalled by a history of military coups.

But militancy and violence will likely continue to be a problem for whoever ends up running the country.

On Saturday, a suspected suicide bomber targeted security forces outside the main gate of a hospital in Khar, the main town in the Bajur tribal region. Four people died in the blast, said political administration official Abdul Haseeb Khan.

The tribal regions border Afghanistan to the west and have been the scene of numerous attacks by militants opposed to the Pakistani government who want to impose their version of Islam on the rest of the country.

Experts unclear how China bird flu infects humans

BEIJING (AP) ? Almost three weeks after China reported finding a new strain of bird flu in humans, experts are still stumped by how people are becoming infected because many appear to have had no recent contact with live fowl.

The uncertainty adds to challenges the Chinese government faces in trying to control the spread of the H7N9 bird flu virus, which has already killed 17 people and infected 66 others in the country.

Understanding how the virus is spreading is a goal of international and Chinese experts assembled by the World Health Organization as they begin a weeklong investigation Friday.

The WHO spokeswoman in China, Helen Yu, says the experts started arriving Thursday and will visit Beijing and Shanghai.

Factbox - Ricin: deadly, easily concealable poison

April 17 - Ricin, one of the deadliest poisons known, was found in a letter addressed to U.S. President Barack Obama, according to preliminary tests.

Following are some key facts about ricin:

- Ricin is made from castor beans, the same substance used to make castor oil. It can be found as a powder, mist, or pellet and is very difficult to trace.

- Ricin is perhaps best known as the poison used to assassinate Bulgarian exile Georgi Markov in London in 1978.

An agent injected Markov with a ricin pellet using a specially rigged umbrella. Markov died a few days later.

- In the 1940s, the U.S. military experimented with using ricin as a possible warfare agent.

- Symptoms of ricin poisoning may begin within less than 10 hours of exposure. They vary depending on whether it was injected, breathed in, or eaten.

When inhaled, symptoms include difficulty in breathing, fever, cough, nausea, sweating and tightness in the chest. Death occurs after blood pressure plummets and breathing stops.

When swallowed, ricin causes vomiting, diarrhea, dehydration, low blood pressure, seizures, and blood in the urine. ?Within several days, liver, spleen, and kidneys might stop working and the poisoned person could die.

- Ricin prevents bodily cells from making the proteins they need. Death can occur within 36 to 72 hours of exposure.

- There is no known antidote. Treatment includes use of respirators, fluids, flushing the stomach and treating low blood pressure.

One former player for all 32 teams will announce a second-day draft pick, the NFL announced on Wednesday.

The second day of the 2013 draft falls on Friday, April 26 and includes Rounds Two and Three. The first round is the previous day, with Rounds Four through Seven occurring on Saturday.

A fan of all 32 teams will also participate in the selection announcement, with one fan getting a chance to announce the pick with the NFL alumnus. Players can announce second- and third-round picks of their former club if they so choose, the league said.

US court hears gene patents case

The US Supreme Court has heard arguments questioning whether the human genome can be claimed as intellectual property.

The case relates to a lawsuit filed by the American Civil Liberties Union in 2009, and centres on whether companies should be able to patent genes.

US authorities have been awarding patents on genes to universities and medical companies for almost 30 years.

The case may have far-reaching repercussions for future gene research.

Currently, researchers and private companies work to isolate genes in order to use them in tests for gene-related illnesses, and in emerging gene therapies.

According to researchers at Weill Cornell Medical College in the US, patents now cover some 40% of the human genome.

The ACLU lawsuit, filed in conjunction with the Public Patent Foundation, relates to seven patents on two human genes held by US firm Myriad Genetics.

'Products of ingenuity'

The genes are linked to breast and ovarian cancer, and Myriad has developed a test to look for mutations in these genes that may increase the risk of developing cancer.

The company argues that the genes patented were "isolated" by them, making them products of human ingenuity and therefore patentable.

The ACLU rejects this argument, saying that genes are products of nature, and therefore can't be patented under US laws.

Speaking immediately after the hearing, the ACLU's lawyer, Christopher Hansen, said: "Myriad did not invent the human genes at issue in this case, and they should not be allowed to patent them.

"The patent system was designed to encourage innovation, not stifle scientific research and the free exchange of ideas, which is what these patents do."

His co-counsel on the case, Daniel Ravicher, said granting patents on genes was "morally offensive".

"Genes are the foundation of life, they are created by nature, not by man," he said.

In 2010 a New York federal court ruled in favour of the ACLU, but an appeals court has on two separate occasions sided with Myriad.

The Supreme Court rejected the appeal court's conclusions, and is now reconsidering the case.

A ruling from the court is expected in June.

The outcome may have significant repercussions for the multi-billion-dollar US pharmaceuticals industry.

Companies like Myriad argue that without patents, the development of genetic tests and therapies will stall as researchers will not be able to recoup the huge levels of investment needed.

"Countless companies and investors have risked billions of dollars to research and develop scientific advances under the promise of strong patent protection," said Peter Meldrum, the president and chief executive of Myriad.

In statements submitted to the Supreme Court, Myriad said the materials and methods protected by the patents took years to develop.

"This was the product of creative, human ingenuity, resulting in significant new applications for human health that were previously unavailable," it said.

Lawmakers pitch immigration plan with strong border control

WASHINGTON (Reuters) - Tighter border security must be one goal of immigration reform if the measure is to pass Congress, lawmakers who support the plan said on Sunday as they tried to build support for a proposal that should be outlined in coming days.

The plan expected later this week envisions toughening border security to discourage new immigrants, while detailing clear steps that aspiring citizens can take if they are already in the country.

Senator Marco Rubio, a leader on immigration reform, said the reform plan will confront the sensitive question of how to treat those who have already entered the country illegally.

"This is not a theory. They are actually here," the Republican said on CBS' Face the Nation, of an estimated 11 million undocumented immigrants.

Proposals to round up and deport undocumented residents are impractical, Rubio said, and existing immigration rules are being abused.

"What we have in place today is not good for anyone except human traffickers and people who are hiring illegal aliens and paying them less than American workers," he said on Fox News Sunday. "This is an issue that needs to be solved."

Rubio, a Cuban-American, is a leader of the so-called Gang of Eight, which has four Democrat and four Republican senators trying to address concerns of domestic industry, labor and other interests who want a voice in the immigration debate.

The first-term senator from Florida was a guest on several Sunday morning political talk shows pushing the immigration reform message.

"Part of my job is to explain to people what it is we've worked on, try to justify it and hopefully gain their support," Rubio said on CNN's State of the Union.

The immigration proposal could come as soon as Tuesday with details still being finalized, Rubio said, but the plan would put citizenship on hold while officials tighten borders and prepare undocumented workers for the tax rolls.

Lawmakers have different views on how much more border security would be required before undocumented residents could seek citizenship but discouraging future illegal immigration was seen as a key to building broad support for the measure.

"Every Republican at the table said we've got to start with border security," Richard Durbin, an Illinois Democrat and another member of the Gang of Eight said on Fox News Sunday.

The questions of immigration reform and gun control will likely consume the senate in coming weeks and help shape the debate in the U.S. House of Representatives, which would have to pass its own version of reform before any measure could become law.

And while labor and industry groups have blessed a key proposal dealing with itinerant workers, many lawmakers are expected to loudly oppose a plan they say does too little to guarantee public safety.

Senator Jeff Sessions, an Alabama Republican, wants the U.S. Immigration and Customs Enforcement agency to have a direct voice in setting benchmarks for who gets to stay in the country.

"When the Gang of Eight first got together, they said enforcement would come first, before legalization," Sessions said on Sunday. "This proposal will not stand up to scrutiny."

Attack kills Iraqi election candidate, 2 others

BAGHDAD (AP) ? Iraqi authorities say a roadside bomb explosion followed by a gunbattle north of Baghdad killed three people, including a Sunni candidate running in the upcoming provincial elections.

Police officials said Sunday's attack occurred when a roadside bomb hit the convoy of Najam Saeed. The blast was followed by shooting between gunmen and the candidate's bodyguards.

Police say two of Saeed's brothers were killed and that the candidate's son and three bodyguards were wounded in the attack near Muqdadiyah town, 90 kilometers (60 miles) north of Baghdad.

Medics in a nearby hospital confirmed the death casualties.

All officials spoke on condition of anonymity because they were not authorized to talk to the media.

At least 13 other candidates have been killed in previous attacks ahead of the April 20 ballot.

Even our most promising rockers would be dead by one misadventure or another. But before this even happened, there would be a Third World War, one that would finish us off before this ugly, Orwellian existence could even begin.

That?s what he said. That?s what David Bowie said on his 1973 album, "Aladdin Sane." So how did he make The Apocalypse sound so groovy that we couldn?t wait for the world to end? Mostly it was the music, which was arguably, the most lyrical, indelibly melodic, and rockin? stuff the man with the orange shag and unmatched eyes had yet made. In any case, on the occasion of "The Next Day," Bowie?s first new album in a decade, it?s time to celebrate the old. "Aladdin Sane" turns 40 in April and it still stimulates with an undimmed intensity.

When it was first released, the stakes were high. With his previous record, which introduced hubristic rocker, Ziggy Stardust, Bowie had finally broken through. After years of folky tunes and false starts, he found false eyelashes and blush worked better. In his glittering jumpsuit and stacked heels, Bowie?s identity may been ambiguous. As for those high stakes? Well, this is the guy who began "The Rise and Fall of Ziggy Stardust and the Spiders from Mars" with a dicey proposition: that the world would end in five years. It was now a year later. What, we space cadets wondered, would he do for an encore?

Make good on his promise. That?s what David Bowie and his wonderfully poisonous Spiders did. What seems most in jeopardy in his brave, barren new world is rock 'n' roll itself. On two tracks, there are distinct references to the extinction of the music we loved. In the album?s opener, "Watch That Man," our humble narrator describes a party where ?an old-fashioned band of married men/Were looking up to me for encouragement.? Everybody knew this had to be Bowie?s cheeky description of The Rolling Stones. Still, to hear those thirtyish thugs depicted that way was really depressing. The only ameliorating aspect, the thing that made the idea tolerable, was that Bowie and band were now rocking harder than the Stones. Led by first lieutenant and guitarist Mick Ronson, "Man," with its power chords and Chuck-Berry-screaming-like-Little-Richard vocal, made it clear who was now The World?s Greatest Rock And Roll Act.

Apr. 12, 2013 ? A genetic analysis of the avian flu virus responsible for at least nine human deaths in China portrays a virus evolving to adapt to human cells, raising concern about its potential to spark a new global flu pandemic.

The collaborative study, conducted by a group led by Masato Tashiro of the Influenza Virus Research Center, National Institute of Infectious Diseases, and Yoshihiro Kawaoka of the University of Wisconsin-Madison and the University of Tokyo, appears in the current edition (April 11, 2013) of the journal Eurosurveillance. The group examined the genetic sequences of H7N9 isolates from four of the pathogen's human victims as well as samples derived from birds and the environs of a Shanghai market.

"The human isolates, but not the avian and environmental ones, have a protein mutation that allows for efficient growth in human cells and that also allows them to grow at a temperature that corresponds to the upper respiratory tract of humans, which is lower than you find in birds," says Kawaoka, a leading expert on avian influenza.

The findings, drawn from genetic sequences deposited by Chinese researchers into an international database, provide some of the first molecular clues about a worrisome new strain of bird flu, the first human cases of which were reported on March 31 by the Chinese Center for Disease Control and Prevention. So far, the new virus has sickened at least 33 people, killing nine. Although it is too early to predict its potential to cause a pandemic, signs that the virus is adapting to mammalian and, in particular, human hosts are unmistakable, says Kawaoka.

Access to the genetic information in the viruses, he adds, is necessary for understanding how the virus is evolving and for developing a candidate vaccine to prevent infection.

Influenza virus depends on its ability to attach to and commandeer the living cells of its host to replicate and spread efficiently. Avian influenza rarely infects humans, but can sometimes adapt to people, posing a significant risk to human health.

"These viruses possess several characteristic features of mammalian influenza viruses, which likely contribute to their ability to infect humans and raise concerns regarding their pandemic potential," Kawaoka and his colleagues conclude in the Eurosurveillance report.

Kawaoka, a faculty member in the UW-Madison School of Veterinary Medicine who also holds a faculty appointment at the University of Tokyo, explains that the majority of the viruses in the study -- from both humans and birds -- display mutations in the surface protein hemagglutinin, which the pathogen uses to bind to host cells. Those mutations, according to Kawaoka, allowed them to easily infect human cells.

In addition, the isolates from patients contained another mutation that allows the virus to efficiently replicate inside human cells. The same mutation, Kawaoka notes, lets the avian virus thrive in the cooler temperatures of the human upper respiratory system. It is in the cells of the nose and throat that flu typically gains a hold in a mammalian or human host.

Kawaoka and his colleagues also assessed the response of the new strain to drugs used to treat influenza, discovering that one class of commonly used antiviral drugs, ion channel inhibitors which effectively bottle up the virus in the cell, would not be effective; the new strain could be treated with another clinically relevant antiviral drug, oseltamivir.

In addition to Kawaoka and Tashiro, co-authors of the Eurosurveillance report include Tsutomu Kageyama, Seiichiro Fujisaki, Emi Takashita, Hong Xu, Shinya Yamada, Yuko Uchida, Gabriele Neumann and Takehiko Saito.
